Abstract
Family law holds a highly strategic position in Islamic jurisprudence as it governs the order and harmony of household life. In Indonesia, the reform of Islamic family law has become a necessity due to the continued dominance of classical fiqh interpretations, which often place women in a subordinate role. This condition has prompted efforts toward legislation that is more modern and responsive to the changing times and the values of gender equality. This study employs a library research method by examining historical, normative, and sociological literature to analyze the process and context behind the enactment of Law Number 1 of 1974 on Marriage. The findings indicate that this law represents a significant milestone in the reform of Islamic family law in Indonesia. It aims to unify the marriage law system, enhance protections for women, and align Islamic legal principles with evolving social realities. In conclusion, Law No. 1 of 1974 serves not only as a legal instrument but also as a reflection of socio-religious transformation, affirming the role of the state in reforming Islamic family law toward justice and equality.
[Hukum keluarga memiliki posisi yang sangat strategis dalam hukum Islam karena mengatur ketertiban dan keharmonisan kehidupan rumah tangga. Di Indonesia, pembaruan hukum keluarga Islam merupakan suatu keniscayaan mengingat masih dominannya pemahaman fiqh klasik yang cenderung memosisikan perempuan secara subordinatif. Kondisi ini mendorong upaya legislasi yang lebih modern dan responsif terhadap perkembangan zaman dan nilai kesetaraan gender. Penelitian ini menggunakan metode studi kepustakaan (library research) dengan menelaah literatur historis, normatif, dan sosiologis untuk mengkaji proses dan konteks lahirnya Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan. Hasil kajian menunjukkan bahwa undang-undang tersebut merupakan tonggak penting dalam reformasi hukum keluarga Islam, yang ditujukan untuk menyatukan sistem hukum perkawinan, meningkatkan perlindungan terhadap perempuan, dan menyesuaikan hukum Islam dengan realitas sosial yang berkembang. Kesimpulannya, Undang-Undang No. 1 Tahun 1974 tidak hanya merupakan instrumen legal, tetapi juga refleksi transformasi sosial-keagamaan yang menegaskan peran negara dalam pembaruan hukum keluarga Islam menuju keadilan dan kesetaraan.]
